Statutory warranty and after-sales service
This policy explains the legal guarantee of conformity applicable to products sold by Install Beer, the procedure for reporting an issue and the conditions for repair, replacement, price reduction, termination of the contract and after-sales service.
The applicable conditions depend on whether the customer is acting as a consumer or as a business or professional, on the purchase date, the country of residence, the type of product and the specific terms agreed.
The legal guarantee must not be confused with the right of withdrawal. Withdrawal allows certain consumers to return a distance purchase within the statutory period, whereas the guarantee protects against defective, incorrect, or non‑conforming products.

2. Statutory warranty, commercial warranty and repair
Statutory guarantee of conformity
This is the mandatory protection granted to the consumer when a product does not comply with the contract, the description, the agreed characteristics, or the reasonably expected requirements.
The main party responsible to the consumer is Install Beer as the seller, without prejudice to any responsibilities that may correspond to the manufacturer, importer, distributor or other operators.
Commercial warranty
This is any additional voluntary commitment offered by Install Beer, the manufacturer or another guarantor. It may extend the duration, coverage or services, but it does not replace or limit the legal warranty.
Out-of-warranty repair
It is a technical service contracted and paid for by the customer when the incident is not covered by a legal, commercial or contractual guarantee.
3. Statutory warranty for consumers
A consumer is understood to be a natural person acting mainly for purposes outside their commercial, business, trade or professional activity, as well as any other person who is legally considered as such.
For new products sold to consumers in Spain, Install Beer is liable for any lack of conformity existing at the time of delivery that becomes apparent within three years thereafter.
Consumers residing in other countries will retain, where applicable, the mandatory protection granted by the legislation of their country of residence.
Issuing an invoice, entering a tax ID number, or purchasing a technical product does not automatically remove consumer status. The primary and actual purpose of the transaction will be taken into account.
4. When a lack of conformity exists
A product may be considered non-conforming when, among other circumstances:
- It does not match the description, model, reference, or variant purchased.
- Does not include the accessories or instructions indicated.
- It does not have the qualities or performance expressly agreed.
- It is not suitable for the ordinary uses of products of the same type.
- It is not suitable for a specific purpose communicated by the customer and accepted by Install Beer.
- It does not have the quality, durability, safety, compatibility or functionality that can reasonably be expected.
- It does not correspond to a binding sample, demonstration or advertisement.
- It has been incorrectly installed by Install Beer or in accordance with insufficient instructions provided by Install Beer or the manufacturer.
- It does not receive the necessary updates when it is a good with digital elements and there is such an obligation.
A difference clearly communicated before contracting and expressly accepted by the consumer will not in itself constitute a lack of conformity.
5. Liability periods
New goods
For new products delivered to consumers in Spain from 1 January 2022, the general period for a lack of conformity to become apparent is three years from delivery.
Previous purchases
Orders placed before 1 January 2022 may be subject to the legal regime in force at the time of contracting.
Delivery date
Unless proven otherwise, it will be understood that delivery took place on the date indicated on the invoice, proof of purchase, or delivery note when the latter is later.
Time limit for filing the claim
The action to claim rights arising from a lack of conformity is subject to the applicable statutory limitation period, which in Spain is five years from the manifestation of the lack of conformity.
It is recommended to report any incident as soon as reasonably possible to avoid further damage and facilitate diagnosis.
6. Presumption and burden of proof
Unless incompatible with the nature of the product or the type of defect, it is presumed that any lack of conformity that becomes apparent within the first two years after delivery already existed at the time the product was delivered.
Once that period has elapsed, the consumer retains their rights for the legal term, although it may be necessary to assess the origin of the issue, taking into account its nature, use, maintenance, installation, age, and technical circumstances.
Install Beer will not impose disproportionate proof requirements on the consumer, nor will it use technical diagnosis to improperly shift onto them a burden that legally corresponds to the seller.
7. Second-hand products
When Install Beer sells a consumer a product expressly identified as used, refurbished, or second‑hand, a liability period shorter than three years may be agreed.
This period must be communicated and accepted before contracting and may not be less than one year from delivery.
Wear, marks or specific limitations that have already been clearly described and accepted by the consumer will not be considered a lack of conformity.
The sale of a discontinued product, a display item, or one with damaged packaging does not automatically make it a second‑hand product if it has not been used and is not described as such.
8. Equipment with software or digital elements
Some equipment may include software, applications, connectivity, firmware, licenses, online platforms, or digital services required for certain functions.
When those digital elements form part of the contract, conformity may also include:
- The advertised functionality.
- The stated compatibility and interoperability.
- The updates necessary to maintain conformity.
- Installation or configuration instructions.
- Reasonably expected safety.
- Supply during the contracted period.
The customer must install the communicated updates and follow the reasonable instructions provided. Failure to install them may affect coverage when it is the direct cause of the issue and the customer has been properly informed.
Third-party platforms, subscriptions or services may also be subject to their own terms and conditions, without prejudice to the legal liability that corresponds to Install Beer for the contracted package as a whole.
9. Repair or replacement
When a product is not in conformity, the consumer will generally be entitled to choose between repair or replacement.
The chosen option may be ruled out when:
- Is impossible.
- It entails disproportionate costs compared with the other solution.
- The alternative can be provided without major inconvenience to the consumer.
To assess proportionality, the following will be taken into account, among other factors:
- The value the product would have if it were in conformity.
- The relevance and consequences of the defect.
- The cost, availability and lead time of each solution.
- The purpose for which the consumer purchased the product.
- The inconvenience that each measure may cause the consumer.
Install Beer may propose a technically equivalent solution, but will not unilaterally replace the product with another of inferior characteristics.
10. Free-of-charge remedy of lack of conformity
When the lack of conformity is covered by the legal warranty, repair or replacement will be free of charge for the consumer.
Free-of-charge coverage includes the necessary expenses, in particular:
- Collection and transport.
- Shipment of the repaired or replacement product.
- Diagnosis required.
- Labor.
- Materials and replacement parts.
- Removal and installation when legally applicable.
The consumer will not be required to pay shipping costs upfront when they are covered, to be reimbursed later, unless a voluntary solution is agreed that does not cause them undue costs or inconvenience.
If the diagnosis reasonably shows that the issue is not covered, Install Beer will inform the customer before carrying out a paid repair.
11. Installed products
When a product has been installed in a way that is consistent with its nature and purpose before the lack of conformity appears, the obligation to repair or replace it may include:
- The withdrawal of the non‑conforming product.
- Installation of the repaired or replaced product.
- Assumption of the necessary removal and installation costs.
This rule will be applied taking into account the nature of the product, the normal method of installation and the specific circumstances.
It does not cover works, adaptations or external elements that were not necessary for an ordinary installation, unless they form part of the contract or the damage arises from an action attributable to Install Beer.
When the product has been incorrectly installed by a third party, it will be assessed whether the issue arises from that installation or from a defect inherent to the product.
12. Price reduction or termination of the contract
The consumer may request a proportionate price reduction or termination of the contract when any of the legally established grounds apply, such as:
- That repair or replacement is impossible or disproportionate.
- Install Beer does not complete the process of bringing the product into conformity within a reasonable time or without significant inconvenience.
- The same lack of conformity reappears after an attempt at repair or replacement.
- That the defect is sufficiently serious to justify an immediate solution.
- That Install Beer states that it will not bring the product into conformity under appropriate conditions.
Price reduction
It will be proportional to the difference between the value the product would have had if it were compliant and its actual value at the time of delivery.
Resolution
This involves returning the product and refunding the price where applicable.
Termination will generally not apply when the lack of conformity is of minor importance, and it is for Install Beer to prove such minor importance where legally required.
If the issue affects only part of the order, the resolution may be limited to the affected products, unless it would be unreasonable to require the consumer to keep the rest.
13. Refund after termination
When termination of the contract is appropriate due to lack of conformity, Install Beer will refund the corresponding price without undue delay.
The refund will generally be made within 14 days following receipt of the product or sufficient proof of its return.
Install Beer will bear the costs of restoring the product when the termination results from a covered lack of conformity.
The refund will be made using the same means of payment used, unless another method is expressly agreed that does not entail costs for the consumer.
14. Suspension of time limits during repair
The period during which the product is at Install Beer’s disposal for repair, replacement, or remedy of lack of conformity suspends the running of the corresponding statutory time limits.
The suspension begins when the consumer makes the product available to Install Beer and ends when they receive the product back in conformity.
Therefore, the time spent handling a covered incident does not consume the remaining period of statutory liability.
15. Recurrence of the same fault
During the year following delivery of the repaired or remedied product, Install Beer will be liable for the lack of conformity that gave rise to the intervention.
When defects of the same origin as those initially reported reappear, it will be presumed that they are the same lack of conformity, unless proven otherwise.
This protection does not replace or reduce the general warranty period that may still be in force.
16. Inbound and outbound documentation
When a consumer hands over a product to bring it into conformity, Install Beer will provide a receipt identifying, where applicable:
- The product, model, SKU, or serial number.
- The delivery or receipt date.
- The order, invoice or case number.
- The reported issue.
- Accessories supplied with the equipment.
- The relevant external condition.
When returning the now-compliant product, proof of the delivery date and a description of the corrective action taken will be provided.
The customer must keep the invoice, proof of purchase, delivery note or any document that can prove the transaction.
The loss of the original invoice does not automatically remove rights when the purchase can be proven by other sufficient means.
17. How to report an incident

It is recommended to provide:
- Order or invoice number.
- Product, reference, variant and SKU.
- Serial number, where applicable.
- Detailed description of the issue.
- Approximate date when it began.
- Photographs or videos.
- Installation and use conditions.
- Pressures, temperatures, voltages or connections used.
- Error messages or equipment indicators.
- Contact details and address where the product is located.
The absence of any of this data will not prevent a claim from being filed, although having it may speed up the diagnosis.
18. Diagnosis and technical checks
Install Beer may request reasonable and secure checks in order to identify the issue and determine the appropriate solution.
Checks may include:
- Checking connections, pressure, and temperature.
- Checking the power supply.
- Inspection of tubes, joints, filters and consumables.
- Reading of errors or logs.
- Evidence by photographs, videos, or video call.
- Collection of the equipment or technical visit.
The customer should only carry out checks that are reasonable, safe and appropriate to their level of knowledge.
You must not open, depressurise, dismantle or tamper with equipment where this may create electrical, refrigeration, mechanical, health or gas-related risks.
When it is necessary to send the product for diagnosis, Install Beer will inform you about the method of delivery, packaging and documentation.
If it is determined that the incident is covered, diagnosis and the necessary work will be free of charge for the consumer.
If the issue is not covered, no paid repair will be carried out without first informing the customer of the conditions or requesting acceptance of the quotation.
19. Transport and collection
When bringing the product into conformity is covered by the legal warranty, Install Beer will arrange or bear the necessary transport costs.
The method will depend on the nature, weight, volume, location and safety of the product.
Bulky, refrigerated, palletized, or pressurized equipment may require:
- Pallet and reinforced packaging.
- Vertical transport.
- Removal of liquids or products.
- Safe depressurisation.
- Disconnection carried out by qualified personnel.
- Tail lift or special access.
The customer must keep the packaging where reasonably possible and follow the shipping instructions provided.
The absence of the original packaging does not automatically void coverage, although other suitable packaging may be required.
Gas cylinders, pressurised containers, liquids, chemicals, batteries or restricted goods must not be sent without authorisation and specific instructions.
20. Situations not covered
A warranty does not cover incidents caused exclusively by circumstances unrelated to an original defect or lack of conformity.
Among them may be:
- Impacts, drops, breakages or damage occurring after delivery.
- Use other than the intended purpose.
- Failure to follow essential safety instructions.
- Pressures, temperatures or voltages outside the permitted limits.
- Freezing, overheating or insufficient ventilation.
- Incorrect electrical connection or external overvoltage.
- Use of incompatible gases, products, or chemicals.
- Blockages caused by lack of cleaning.
- Limescale, sediment, or inadequate water quality.
- Mandatory maintenance not carried out.
- Unauthorised handling or modification.
- Incorrect installation carried out by a third party.
- Damage caused by defective third-party components.
- Force majeure, fire, flooding or pests.
- Normal wear consistent with the use and service life of the component.
These exclusions will only apply where a demonstrable causal relationship exists between the circumstance and the fault.
The existence of incorrect installation, lack of maintenance or tampering does not automatically exclude any independent defect that the product may already have had.
21. Wear, consumables and maintenance
Certain components have a service life that depends on use, environmental conditions, cleaning, beverage, pressure or maintenance.
Among them may be:
- Gaskets and seals.
- Filters and cartridges.
- Flexible hoses.
- Membranes.
- Lubricants.
- Cleaning products.
- Batteries and cells.
- Bulbs or consumable light elements.
- Bearings, valves and wear parts.
- Hygienic consumables or water treatment consumables.
Normal depletion of a consumable does not constitute a lack of conformity.
There may still be a lack of conformity when the component fails prematurely due to a defect, does not reach the advertised durability or does not meet reasonably expected characteristics.
The customer must follow the cleaning, inspection and replacement intervals indicated by Install Beer or the manufacturer.
22. Installations carried out by third parties
Installation by a third party does not automatically void the product warranty.
When a fault may be related to the installation, Install Beer may request information about:
- Installer person or company.
- Layout and photographs of the installation.
- Connections, tubing and accessories used.
- Pressures and temperatures.
- Power supply.
- Maintenance performed.
If the fault arises exclusively from an incorrect installation not carried out by Install Beer, the correction of the installation will not be covered by the product warranty.
If the defect arises from the product itself or from incorrect or insufficient instructions, the corresponding rights will apply even if the installation was carried out by a third party.
23. Manufacturer’s commercial warranty
Some manufacturers offer an additional commercial warranty with their own duration, territorial scope or procedure.
The commercial guarantee will be binding on the guarantor in accordance with its statement and the advertising available before contracting.
It may include conditions such as:
- Product registration.
- Preservation of the serial number.
- Periodic maintenance.
- Intervention by an authorized technical service.
- Coverage limited to certain parts.
- Specific territorial scope.
Install Beer will inform you of these conditions when they are available and relevant to the purchase.
The manufacturer’s warranty does not replace or reduce Install Beer’s liability to the consumer under the statutory warranty.
Install Beer may handle the incident with the manufacturer or authorized service center, but will remain the responsible point of contact for the consumer where legally required.
24. Businesses and professionals
Transactions carried out mainly for a business, professional, industrial, hospitality or commercial activity are not automatically subject to the statutory guarantee regime reserved for consumers.
For B2B transactions, the following will apply:
- The conditions expressly indicated in the product sheet or quotation.
- The commercial warranty offered by Install Beer or the manufacturer.
- The specific conditions of the project or supply.
- The applicable civil and commercial legislation.
- The commitments expressly assumed by the parties.
The duration of the B2B warranty may vary depending on the product, manufacturer, application, intensity of use and supply conditions.
Where no specific duration has been indicated, you must consult the product documentation, quotation or order confirmation.
Under no circumstances does a B2B warranty exclude the professional customer’s rights arising from an original defect, incorrect delivery, failure to meet specifications or conduct attributable to Install Beer.
The business customer must inspect the goods within a reasonable period and report any issues in accordance with the nature of the supply and the applicable commercial law.
25. Installations and technical services
Installation, assembly, cleaning, maintenance, repair and commissioning work will be carried out in accordance with the accepted quotation, work order and conditions.
Install Beer will be liable for the proper execution of the work it has carried out and for the materials supplied within the applicable legal or contractual time limits.
The warranty for a service covers defects directly related to the work carried out, but not unrelated faults, pre-existing defective installations or subsequent actions by third parties.
If an incident has several causes, it will be determined which part corresponds to the service performed, the product, the existing installation, or the use.
When new parts are used in a repair, they will retain the statutory or commercial warranty corresponding to them, without prejudice to the warranty of the service itself.
26. Out-of-warranty repairs
When a repair is not covered by the warranty, Install Beer may offer a paid technical service.
Before carrying out work that generates a significant cost, a quotation will be provided or authorization will be requested up to a maximum amount.
The quote may include:
- Diagnosis.
- Labor.
- Parts and materials.
- Travel.
- Collection and transport.
- Applicable taxes.
- Estimated timeframe.
Paid repairs carried out for consumers will have the minimum warranty required by the applicable regulations.
As a general policy, Install Beer guarantees for a minimum of six months the paid repair work provided to consumers, from its completion, with respect to the fault repaired and any deficiencies directly caused by the intervention.
This warranty does not affect any broader coverage that may apply to newly installed parts or other rights recognized by law.
In B2B repairs, the duration and scope will be indicated in the quotation or invoice. If no specific condition is indicated, the mandatory applicable period will apply and coverage will be limited to the work carried out and parts supplied.
A new fault that is different and has no causal link with the previous intervention will not be considered a repetition of the earlier repair.
27. Spare parts and after-sales service
Install Beer will endeavor to provide spare parts, documentation and technical service for the reasonable useful life of the products, either directly or through the manufacturer, distributor or authorized service provider.
Actual availability may depend on:
- The brand and model.
- The manufacturing date.
- Continuity of the manufacturer.
- The existence of equivalent references.
- Commercial or territorial restrictions.
- The technical and economic feasibility of the repair.
Where Spanish consumer regulations apply, the manufacturer must ensure adequate technical service and the availability of spare parts for at least the minimum legal period from the time the product ceases to be manufactured.
The prices of parts, labour, travel and other items will be itemised in the quotation or invoice where applicable.
Install Beer may propose an updated or technically equivalent replacement when the original part has been superseded or discontinued, informing you in advance of any relevant differences.
28. Security and suspension of use
The customer must immediately stop using the equipment when they notice:
- Gas, refrigerant, water or product leaks.
- Burning smell, smoke or overheating.
- Sparks, damaged cables or electrical risk.
- Abnormal pressures.
- Structural breakages.
- Security alarms.
- Contamination or hygiene risk.
- Any circumstance that may cause personal injury or property damage.
The product must only be disconnected or isolated when this can be done safely and in accordance with the applicable instructions.
In an emergency, the relevant public services must be contacted and you must not wait for the ordinary processing of a warranty claim.
Knowingly continuing to use dangerous equipment can worsen the fault and cause damage that cannot be attributed to the initial defect.
29. Data, settings and contents
Before sending equipment with memory, software, or connectivity, the customer must back up data and settings where possible.
Diagnosis or repair may require:
- Restore settings.
- Update firmware or software.
- Replacing electronic modules.
- Remove incompatible configurations.
- Temporary access to technical records.
Install Beer will process personal data only to the extent necessary to manage the service and in accordance with the Privacy Policy.
The customer must not send passwords or confidential information that is not necessary. When providing access is essential, a secure and limited method will be used.
30. European and international purchases
European Union consumers
Consumers from other Member States will have, at a minimum, the protection granted by European regulations and will retain the mandatory provisions that apply in their own country.
The method of collection or repair may be adapted to the country, product, carrier and available service network, without reducing legal rights.
European businesses
In intra‑Community B2B transactions, the conditions of the quotation, product and manufacturer will apply, in addition to the agreed legislation and jurisdiction.
Non-EU countries
Repairs and returns may require export documentation, temporary import, re-import or returned-goods documentation.
Before sending a product from outside the European Union, the customer must request instructions to avoid unnecessary taxes, duties, storage charges or customs holds.
For Ex Works deliveries or shipments organized entirely by the professional customer, logistical responsibility will be determined in accordance with the applicable Incoterm or agreed terms.
31. Frequently Asked Questions
Do all products have a three‑year warranty?
The general three-year period applies to new goods sold to consumers in Spain from 1 January 2022. B2B purchases, used products, services and international operations may be subject to a different regime.
Who is liable to the consumer?
Install Beer as the seller is the main point of contact for the consumer. The manufacturer’s warranty is additional.
Do I have to pay the shipping costs for a defective product?
Not when the lack of conformity is covered. Remedying the lack of conformity must be free of charge, including the necessary transport costs.
Can I choose between repair and replacement?
Generally yes, unless one option is impossible or disproportionate compared with the other and the alternative can be carried out without major inconvenience.
Can I request a direct refund?
It will apply in the cases provided for by law, for example when repair or replacement is impossible, fails, is not carried out within a reasonable time, or the defect is sufficiently serious.
What happens while the equipment is being repaired?
The calculation of legal time limits is suspended from the moment the product is made available to Install Beer until it is returned in compliant condition.
What happens if the same fault appears again?
During the year following the return of the repaired product, it is presumed that defects of the same origin correspond to the same lack of conformity.
Does the warranty cover limescale or lack of cleaning?
Not when it is proven that the fault has been caused exclusively by limescale, dirt, insufficient maintenance or use contrary to the instructions. It will cover a defect that is independent of the product.
Does an installation carried out by third parties void the warranty?
Not automatically. Only damage actually caused by incorrect installation or third-party mishandling may be excluded.
Do I need to keep the original packaging?
It is not a general requirement to maintain the warranty, although it is advisable for transporting the product safely.
Is the invoice essential?
It is the simplest proof, but the purchase may be evidenced by other sufficient documents, such as the order, delivery note or payment record.
How long does a repair take?
It depends on the issue, product, spare parts and transport. Covered actions must be carried out within a reasonable time and without major inconvenience to the consumer.
Do technical services also have a warranty?
Yes. Services are liable for their proper performance during the applicable statutory or contractual period, and paid repairs for consumers have the coverage indicated in this policy.
